Property Lawyers in Kolkata

Buying, selling or inheriting property in Kolkata runs through a chain of offices that rarely talk to each other: the Registrar under the Directorate of Registration and Stamp Revenue, the Kolkata Municipal Corporation for mutation and assessment, the BL&LRO for land records, and WBRERA for anything bought from a developer. One missing link in that chain surfaces years later as a dispute.

We handle the full cycle. Title search and due diligence before you pay a token, drafting and vetting of agreements and deeds, registration and stamp duty assessment, mutation after purchase, and litigation when a transaction has already gone wrong.

What we handle

  • Title search and due diligence for flats, land and commercial units
  • Agreement for sale, deed of conveyance, gift deed, power of attorney
  • Stamp duty assessment and registration at the Registrar's office
  • KMC mutation, assessment and property tax disputes
  • WBRERA complaints against developers for delay, deviation or refund
  • Partition suits, declaration of title and injunction matters
  • Cooperative housing society disputes and transfer of share

Common questions

What documents should I check before buying a flat in Kolkata?

At minimum: the chain of title deeds going back at least 30 years, the latest mutation certificate and tax receipts, the sanctioned building plan from KMC, the completion or occupancy certificate, a WBRERA registration if the project is covered, and a non-encumbrance search at the Registrar's office. For resale flats, also check the society's no-objection and any pending dues.

How is stamp duty calculated on property in West Bengal?

Stamp duty is charged as a percentage of the market value assessed by the Registrar, not the price you agreed, and the rate depends on the location and value band of the property. Registration fee is charged separately. The Directorate of Registration allows online market value assessment before you book an appointment, which we do as part of every transaction.

What is mutation and is it compulsory after buying a flat?

Mutation records your name as the owner in the municipal assessment register so that property tax is raised in your name. It is not what gives you title, the registered deed does that, but without it you will face problems in resale, loans and utility connections. In Kolkata it is done at the KMC Assessment-Collection department of your borough.

Can I file a WBRERA complaint if my builder has delayed possession?

Yes, if the project is registered with WBRERA or ought to have been. You can seek interest for delay, refund with interest, or compensation. The complaint is filed online and heard by the Authority or the Adjudicating Officer depending on the relief. Where the project predates the Act or is outside its scope, the consumer commission or a civil suit remains available.
