Media, Defamation and Online Reputation Lawyers in Kolkata

Crepo Legal grew out of a communications background, and this is the practice area where that shows. Defamatory posts, fake reviews, leaked content, advertising complaints, influencer contracts and copyright claims sit at the intersection of law and public relations, and they need to be handled with both in mind.

We act for businesses, public figures, creators and media companies on defamation, content takedown, advertising and endorsement compliance, and copyright and licensing.

What we handle

  • Civil and criminal defamation, both prosecution and defence
  • Takedown of defamatory, infringing or private content from platforms and search results
  • Cease and desist notices and pre-litigation reputation strategy
  • Influencer, endorsement and advertising compliance (ASCI and Consumer Protection guidelines)
  • Copyright registration, licensing and infringement for creators, agencies and publishers
  • Media production contracts, talent agreements and release forms
  • Press, broadcast and digital media regulatory issues

Common questions

How do I get a defamatory post or fake review removed?

The first step is usually a notice to the platform through its grievance mechanism, identifying the content and the legal basis for removal. Platforms are required to act on certain categories within fixed timelines. Where the platform does not act, or the author is known, a civil suit for injunction and damages or a criminal complaint for defamation follows. The approach depends on how fast you need it down and whether you want the author held accountable.

What are the legal requirements for influencer advertising in India?

Paid or incentivised content must be clearly disclosed as an advertisement, using prominent labels that cannot be missed. Claims made must be substantiated, and certain categories such as health and finance carry additional requirements. Both the brand and the influencer can be held responsible for misleading advertisements under consumer protection law.

Is defamation a criminal offence in India?

Yes. Defamation is both a civil wrong, for which damages and injunction can be claimed, and a criminal offence under the Bharatiya Nyaya Sanhita, punishable with imprisonment or fine. The criminal route is faster to initiate but the civil route is where compensation is recovered. Truth, fair comment and privilege are the main defences.
